{"id":4390,"date":"2022-04-22T14:46:16","date_gmt":"2022-04-22T06:46:16","guid":{"rendered":"https:\/\/csspsinag.wordpress.com\/?p=4390"},"modified":"2022-04-22T14:46:16","modified_gmt":"2022-04-22T06:46:16","slug":"bongbong-nakatakas-sa-huling-dq-case","status":"publish","type":"post","link":"https:\/\/sinag.press\/news\/2022\/04\/22\/bongbong-nakatakas-sa-huling-dq-case\/","title":{"rendered":"Bongbong, nakatakas sa huling DQ case"},"content":{"rendered":"\n<p>Ibinasura ng Commission on Elections (COMELEC) First Division noong Miyerkules, Abril 20, ang huling disqualification case laban kay presidentiable Ferdinand \u201cBongbong\u201d Marcos Jr. na inihain ng grupong Pudno nga Ilokano.<\/p>\n\n\n\n<!--more-->\n<!--noteaser-->\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity is-style-wide\" \/>\n\n\n\n<figure class=\"wp-block-image size-thumbnail\"><a href=\"https:\/\/sinag.press\/news\/wp-content\/uploads\/2022\/03\/ni-ron-imperial.png\"><img decoding=\"async\" src=\"https:\/\/sinag.press\/news\/wp-content\/uploads\/2022\/03\/ni-ron-imperial.png?w=97\" alt=\"\" class=\"wp-image-4014\" \/><\/a><\/figure>\n\n\n\n<p>Ibinasura ng Commission on Elections (COMELEC) First Division noong Miyerkules, Abril 20, ang huling disqualification case laban kay presidentiable Ferdinand \u201cBongbong\u201d Marcos Jr. na inihain ng grupong Pudno nga Ilokano.<\/p>\n\n\n\n<p>Noong Disyembre 2021, penitisyon ng grupo na hindi maaaring tumakbo si Bongbong dahil sa hindi nito pag-file ng kanyang Income Tax Returns (ITR).<\/p>\n\n\n\n<p>Maaalalang napagpasyahan noong 1995 ng Quezon City Regional Trial Court (RTC) na nagkasala si Bongbong sa kasong hindi pag-file ng ITR simula 1982 hanggang 1985.<\/p>\n\n\n\n<p>Subalit sa 29-page na desisyon, ipinagtibay nina Commissioner Socorro Inting, Aimee Ferolino, at Aimee Neri na kwalipikato si Bongbong upang tumakbo sa pagkapangulo. Tinutulan din nila ang ang mga argumento ng mga nagpetiston.<\/p>\n\n\n\n<p>Anila, hindi sila naniniwalang mayroong \u201cmoral turpitude,\u201d na ground para sa diskwalipikasyon, sa kasong hindi pag-file ng ITR.<\/p>\n\n\n\n<p>Dagdag pa nila, hindi umano \u201cinherently wrong\u201d ang hindi pag-file ni Marcos, Jr. ng ITR. Ayon sa desisyon, ito ay pawang obligasyon lamang na minandato ng batas.<\/p>\n\n\n\n<p>\u201cThis is supported by the fact that the filing of income tax return is only an obligation created by law and the omission to do so is only considered as wrong because the law penalizes it,\u201d ayon sa dokumento.<\/p>\n\n\n\n<p>Anila, bagaman hindi nakapag-file ng ITR si Marcos, Jr., hindi umano maaaring makasuhan ang kandidato ng tax evasion.<\/p>\n\n\n\n<p>\u201cHe may have been neglectful in performing this obligation, it however does not reflect moral depravity,\u201d dagdag ng mga commissioners.<\/p>\n\n\n\n<p>Paliwanag nila, sa criminal law, mayroong magkaibang konsepto ng \u201cmala in se\u201d at \u201cmala prohibitum.\u201d<\/p>\n\n\n\n<p>Maaalalang si Ferolino ang pinangalanan ni dating COMELEC commissioner Rowena Guanzon na nag-delay umano ng paglalabas noong Pebrero ng naunang desisyon ng First Division.&nbsp;<\/p>\n\n\n\n<p>Ani Guanzon, nabili umano si Ferolino ng mga Marcos upang harangin ang paglalabas ng pinal na desisyon. Ito naman ay itinanggi noon ni Ferolino, at ibinaling ang paratang kay Guanzon na sinisira raw ang integridad ng COMELEC.<\/p>\n\n\n\n<p>BASAHIN: <a href=\"https:\/\/bit.ly\/3ExBeA6\">https:\/\/bit.ly\/3ExBeA6<\/a>&nbsp;<\/p>\n\n\n\n<p>Isinaad naman ni Comelec spokesperson James Jimenez, &#8220;What it says a crime mala in se (&#8220;evil in itself&#8221;) is a crime that is by itself is naturally wrong \u2014 for example, murder. You don\u2019t need a law to tell you that murder is wrong, but there are some offenses that are mala prohibitum (&#8220;wrong because prohibited&#8221;) which means they are considered wrong under the law only because special law exists to penalize it. For example, cutting down a tree is not inherently [wrong].\u201d<\/p>\n\n\n\n<p>Mahigpit itong tinutuligsa ng mga grupong nagpetisyon at mga taga-suporta nito bilang isang pagnanakaw sa pera ng taumbayan ang ginawa ni Marcos, Jr. Pagdidiin ng mga kritiko, obligasyon ng mamamayang magbayad ng buwis kaya&#8217;t hindi katanggap-tanggap na ito ay takasan na lamang ng anak ng diktador.&nbsp;<\/p>\n\n\n\n<p>Subalit giit ni Guanzon, \u201c[It] cannot always be ascertained whether moral turpitude does or does not exist by classifying a crime as malum in se or as malum prohibta, since there are crimes which are mala in se and yet but rarely involve moral turpitude and there are crimes which involve moral turpitude and are mala prohibita only.\u201d<\/p>\n\n\n\n<p>Sa kabila ng mga petisyon ng pagkadiskwalipika at bilyun-bilyong halaga ng utang sa bayan, nagpapatuloy si Marcos, Jr. sa pangangampanya at pagliban sa mga presidential debates. Naglipana rin ang mga ulat ng ilang botante patungkol umano sa vote buying ng kampo ng tambalang Marcos-Duterte.&nbsp;<\/p>\n\n\n\n<p>Gayunpaman, patuloy na naninindigan ang mga nagpetisyon para sa diskwalipikasyon ni Bongbong.
